Secara umum, jumhur fuqaha' Mazhab Syafie menyatakan bahawa aurat wanita bukan Muslim dengan wanita Muslim adalah sama seperti mana batasan aurat wanita Muslim dengan lelaki ajnabi.In general, the majority of jurists (jumhur fuqaha') of the Shafie school hold that the aurat (parts of the body required to be covered) of a non-Muslim woman before a Muslim woman is the same as the aurat limit of a Muslim woman before a non-mahram man (ajnabi, an unrelated man not within the unmarriageable kin).
Namun terdapat juga pendapat lain dalam Mazhab Syafie yang menyatakan bahawa dibolehkan wanita bukan Muslim melihat apa yang terzahir pada wanita Muslimah ketika bekerja.However, there is also another view within the Shafie school which holds that it is permissible for a non-Muslim woman to see what is ordinarily visible of a Muslim woman while she is working.
Terdapat juga pendapat lain dalam Mazhab Syafie yang menyamakan aurat wanita bukan Muslim seperti aurat sesama wanita Muslim atas alasan bahawa mereka dari jantina yang sama.There is also another view within the Shafie school that treats the aurat of a non-Muslim woman the same as the aurat between fellow Muslim women, on the basis that they are of the same gender.
Dalam kitab Mughni Muhtaj karangan Al-Syirbani, ada menyatakan bahawa tidak dibezakan aurat Muslim dengan bukan Muslim dari jantina yang sama seperti mana aurat sesama Muslim dari jantina yang sama.In the book Mughni Muhtaj by Al-Syirbani, it is stated that no distinction is made between the aurat of a Muslim and a non-Muslim of the same gender, just as with the aurat between fellow Muslims of the same gender.
Atas dasar kepelbagaian pandangan dalam Mazhab Syafie, maka mesyuarat Majlis Penasihat Syariah telah memutuskan bahawa;On the basis of this diversity of views within the Shafie school, the meeting of the Shariah Advisory Council has decided that:
- Keutamaan dalam pemilihan jururawat adalah dari kalangan wanita Muslim.Priority in the selection of nurses is to be given to Muslim women.
- Sekiranya tiada kepakaran dalam kalangan wanita Muslim, maka dibolehkan untuk melantik jururawat dalam kalangan wanita bukan Muslim. Walaupun terdapat perbahasan mengenai batasan aurat, namun ia lebih ringan berbanding mengambil jururawat dalam kalangan kakitangan lelaki. Hal ini kerana aurat lelaki dengan wanita adalah jelas, sedangkan aurat antara sesama wanita Muslim dengan bukan Muslim terdapat pelbagai pendapat lain yang memberikan keringanan dalam menentukan batasan aurat tersebut.If the required expertise is not available among Muslim women, it is permissible to appoint nurses from among non-Muslim women. Although there is scholarly discussion regarding the aurat limit, it is a lighter matter than engaging nurses from among male staff. This is because the aurat between a man and a woman is clear-cut, whereas regarding the aurat between Muslim and non-Muslim women there are various other views that provide latitude (keringanan) in determining that aurat limit.
